Planning and Zoning Board

MAJOR FUNCTIONS AND ACTIVITIES:

The Board shall act in an advisory capacity to the City Commission and make such studies and investigations, in addition to those required by this chapter, as may be requested by the City Commission.  The Board shall have such other duties as prescribed by law, this chapter, and other zoning ordinances of the city.  It shall from time to time, on its own initiative or at the request of property owners of the City Commission, make studies and recommendations for the supplement repealing and amending of district and area regulations and restrictions.

Designated as local planning agency.

The Planning and Zoning Board is hereby designated as the local planning agency pursuant to Section 163.3164(12), Florida Statutes.

The Board is hereby assigned the responsibility of the preparation of the comprehensive plan after hearings to be held after due public notice, and shall make recommendations to the City Commission regarding the adoption of the plan.

The Board shall have such powers as are necessary to accomplish its purpose pursuant to Section 163.3161 Florida Statutes, et seq., and shall expend such funds from time to time, upon the approval of the City Commission, as shall be allocated for its use in preparing the comprehensive plan.

Decisions of the Planning and Zoning Board in quasi-judicial proceedings are subject to appeal to the City Commission by either the city, petitioner, or an "affected person" as defined in § 37.02 based on lack of "competent and substantial evidence" to support the Board's ruling. Any person seeking to appeal must file a written request to appeal with the Administrative Services Director or his or her designee within eight days after the Planning and Zoning Board has rendered a final decision. The appeal shall be presented to the City Commission at its next available meeting for a final determination as to whether or not there was "competent and substantial evidence" to support the Board's ruling. Hearings before the City Commission are not trial de novo but rather appellate in nature. Appeals shall be limited to the written record and any new additional evidence presented. Hearings before the City Commission shall be limited to 15 minutes. For purposes of this subchapter, COMPETENT AND SUBSTANTIAL EVIDENCE shall mean evidence shall be deemed competent to the extent that it should be sufficiently relevant and material so that a reasonable person would accept it as adequate to support the conclusion reached. Evidence shall be deemed substantial if it will establish a substantial basis of fact from which the fact at issue can be reasonably inferred, or such relevant evidence as a reasonable mind would accept as adequate to support the conclusion. 

The Planning and Zoning Board also acts as the city's Architectural Review Board.
