The Florida Legislature recently
enacted legislation which amended references to Occupational
Licenses. Effective immediately, the term "Occupational License
Fee" was amended to read "Local Business Tax," and "Occupational
License" was amended to read "Local Business Tax Receipt."
The Florida Legislature was
prompted to make these changes in response to misrepresentations
by contractors to consumers during the 2004 and 2005 hurricane
seasons. The Legislature found that some unscrupulous persons
presented local "occupational licenses" to consumers as
proof of "competency" to perform various repairs and services.
The legislature determined that changing the name of the item
issued by local governments from occupational license tax
to local business tax may eliminate some
fraudulent misrepresentations.
The City Commission of the City
of Pembroke Pines subsequently enacted Ordinance No. 1576,
instituting changes in accordance with State law.

Applications are obtained in the Building &
Zoning Division. You will need a Local Business Tax Receipt/ Zoning
Application Form, and if applicable the Restricted Local Business Tax
Form (operating business from residence). Legal description of the
business address is required. A driver’s license or a form of picture
identification is required because forms must be notarized. Completed
applications must be submitted to the Building & Zoning Dept.
Every
commercial business owner applying for a Local Business Tax Receipt must
submit proof of sanitation service through the City of
Pembroke Pines Utilities Dept.

. If the new business
owner's landlord and/or managing agent are responsible for
garbage have
them supply you with a copy of the Utilities Billing Account number that
is linked to Sanitation Service. The Local Business Tax Receipt
cannot be issued with out proof of Sanitation Service through the City
of Pembroke Pines.
The
Building Division will advise you if your business location requires any
inspections. Applications are reviewed and signed off by Building &
Zoning, normally within 7-10 working days. The approved paperwork is
forwarded to the Local Business Tax Receipt Division (5th floor).
The
Local Business Tax Receipt Division will notify you when the application
has been approved, then you may come to City Hall and pay your Local
Business Tax. The Receipt will be mailed to you within 5-7 days of
payment.
A
Local Business Tax Receipt from Broward County must also be obtained
after the issuance of Pembroke Pines Local Business Tax Receipt. This
may be done at the Broward County Governmental Center located at 115 S.
Andrews Ave., Ft. Lauderdale, Florida. Tel: (954) 765-4697.
If
you have a FICTITIOUS NAME for your business you must have that name
registered with the Dept. of State. Filing is done through Tallahassee
(850) 488-9000. Applications may be picked up at the City of Pembroke
Pines Local Business Tax Receipt Division or at the Local Business Tax
Receipt office for Broward County located at 115 S. Andrews Ave., Ft.
Lauderdale, FL, in the Main Lobby. You must have this State registration
before Receipt can be issued.
