RESTRICTED OCCUPATIONAL LICENSE

THE CODE OF ORDINANCE FOR THE CITY OF PEMBROKE PINES SECTION 120.02 - PERSONAL PROFESSION OR OCCUPATION.

Any person engaged in a personal profession or occupation which requires the use of his own personal skill or talent but which does not involve the creation, maintenance, distribution or sale of merchandise or goods may apply for a restricted professional or a restricted occupational license upon payment of the license fee provided for such a license. Such applicant may list his home address as a place of business for the purpose of complying with Section 115.15 subject to all of the terms and conditions of Section 120.02 of the City of Pembroke Pines Code of Ordinance attached hereto and with this reference made a part hereof as Exhibit "A".

EXHIBIT "A"

Section 120.02 Personal Profession or Occupation

(A) Any person, corporation, partnership, or other business entity engaged in a personal profession or occupation which requires the use of his/her own personal skill or talent, but which does not involve the creation, maintenance, distribution, or sale of any merchandise or goods, may apply for a restricted professional or a restricted occupational license upon payment of the license fee provided for such a license. The applicant may list his home address as a place of business for the purpose of complying with Section 115.15(B), and may use his home as an office or place of business to conduct his home occupation.

A home occupation, as described in this section shall mean, an accessory use of a portion of a dwelling unit as a personal office or business by a resident of the dwelling only. Home occupations must be secondary to the use of the dwelling for residential purposes and shall not change the character of the dwelling unit thereof.

Restricted professional or restricted occupational licenses to operate a home occupation, subject to the following restrictions:

(1) The applicant shall not use the premises of his home for the creation, storing, distribution, repair, or sale of any merchandise or goods.

(2) The licensee may not use his home address for the purpose of advertising or soliciting business through printed material or any other media.

(3) No employees, independent contractor, or employees of an independent contractor may be permitted on the premises at any time in connection with the authorized use for which the license is issues.

(4) No sign of any type may be posted or displayed on the premises which might serve to indicate that the premises will be used for a restricted professional or restricted occupational use.

(5) No vehicles with any signs painted on them which might serve to indicate that the premises is being used for a restricted professional or restricted occupational use shall park on the premises, except that such a vehicle may be parked within a closed garage in a manner which makes it impossible to be seen from a public right-of-way.

(6) No traffic shall be generated by such home occupation in greater volume than would normally be expected in the neighborhood.

(7) There shall be no display of goods, machinery, equipment nor any performance of work visible or audible from any street or adjoining property, nor shall there be any sign identifying or providing any information of any nature regarding the home occupation.

(8) No equipment or process shall be used in any home occupation which creates noise, vibration, glare, fumes, odors, or electrical interference detectable to the normal senses off the premises.

(9) No home occupation shall occupy more than 25% of the total floor area of a dwelling unit exclusive of any open porch, attached garage, or similar space not intended to be occupied as living quarters.

(10) No home occupation shall be conducted in any accessory building.

(B) The applicant acknowledges that upon the issuance of a restricted professional or restricted occupational licenses to operate a home occupation, the city shall have the right to inspect, at reasonable times, the premises upon which the home occupation is conducted to insure compliance with the foregoing standards and conditions, and investigate complaints, if any.

(C) Any violation of this section may result in a fine in accordance with §120.99 of the Code of Ordinances. Additionally, the city may revoke any home occupational license for non-compliance with this section, in accordance with the provisions §32.035 et seq. of the city’s Code of Ordinances.

(D) No home occupational license issued pursuant to this section shall be transferable, assignable or otherwise alienable.

(E) Nothing in this section shall be deemed to require a home occupational license for an individual who, in the normal course of business, brings work material into the residence for review, preparation, dictation, or other routine process including, but not limited to jobs which are all "take home" work from another business location or employment.
